Now for the folks that are wishing to just get home without what they consider the inconvenience of it all there are immediate ways to have this wish. We know them and here are some of them:
- You may be exempted for health reasons. You must submit a note from your doctor with the Jury Certification Form. Ask your doctor to write the relevant information on a prescription pad page and sign it. This is not a situation where you can call in with a cold.
- If you are a full-time student, you may be exempted.
- Serving as a juror would cause you extreme hardship. This could apply if, for example, you are a nursing mother, or self-employed and your business would be threatened by your absence.
- Firm travel plans or other vacation plans conflict with the jury selection or trial date. Do not make plans right after receiving the notice and traveling to your aunt’s may not count.
As a juror, most people would pray for a small case that they have never heard about. You read about crime and sensational crimes everyday now and before heading into a courtroom your mind may be made up even though you cannot be to sure if you are getting facts or sensational journalism.
So we have looked at some facts and now we will look at you as a human being. Let us say you draw the big one, a sensational case that has been splashed all over the news. This is going to take weeks of evidence, questioning and people to conclude. You, somehow, had no opinion of the case before hand but are sitting there watching the accused for all of this time. The time we are talking about is spent away from family, friends, and work. It all starts to wear on you. Due to the feelings of isolation and resentment, there is no way that a decision is not made way before you are given instructions and holed up in a room with other jurors who you potentially do not like.
Let us face facts, after being put through this most people will either go with the gut than the facts and minds will be made up before a trial is even over or entering the room.
In this writer’s opinion because of the outlet of media and the surrounding elements there is no honest way a person can be judged fairly whether guilty or innocent.
So the question has to be asked, is there such a thing as a fair trial anymore? The answer would be......
